Who are our clients?Property Donation Group assists any timeshare or vacation club owner who no longer wants to or simply can't use their timeshare any longer. Most of our clients regularly donate to charities anyway and have donated real estate, boats, cars, trucks and other non-cash donations.
Some of our clients have tried to sell their properties by paying an up front listing or advertising fee and received no results. Many clients have children who do not want to inherit their timeshare. Most owners realize they can rent a condo anywhere at any time for a fraction of the cost of a timeshare and are simply fed up with the timeshare system of vacationing.

How much will my tax deduction be?
You are allowed to deduct the "Fair Market Value" of the timeshare on your taxes if you itemize your tax return. Once the transfer of ownership to the charity is complete, your chosen charity will send you a receipt as proof of your donation. The receipt usually will not have a value on it - the fair market value is determined by you and your tax preparer, but you must get an appraisal for the timeshare if you decide to claim the fair market value of the timeshare above $5,000. Note that appraisals for timeshares can be quite expensive with most costing more than $500. If you need to get an appraisal for tax purposes, get it in writing that the appraiser will guarantee their appraisal amount for the timeshare in tax court. Timeshare owners also frequently want to know if they can donate the use of the timeshare for one week to charity. This tax question usually arises when for some reason the timeshare owner is unable to use or rent out their week and will lose it. Unfortunately, the Internal Revenue Service doesn't allow a deduction for a gift of "right to use" Rental.
Why should I donate rather then try to sell my timeshare?
Selling a timeshare on your own can take a lot of time and energy. You save this when you donate to a charity. The process is taken care of in a quick manner. This means that you don't have to continue to pay maintenance fees, taxes and special assessments while the timeshare sits on the market.
Your donation is tax deductable. In many cases, donating your timeshare will net you more proceeds than trying to resell. This is because you will be able to claim the fair market value of the timeshare against your taxes and there are many fees involved with reselling.

In states that require an attorney, we use only attorneys experienced with timeshare closings.
Important notice: please be aware that in certain states, an attorney must be involved in the transfer of timeshare property. However we make all necessary arrangements to handle your closing through associate attorneys when necessary. We DO NOT charge any additional fees for this service. Attorney participation is mandatory in the following states: Florida, Georgia, Illinois, New Jersey, New York, North Carolina, Kentucky, Louisiana, Maryland, Michigan, Oregon, South Carolina, Virginia, West Virginia, Washington (State), District of Columbia (Washington DC), and Ohio.
The Process:
Estoppel Certificate/Resort Disclosure Packet
Preparation of Estoppels documents based on information provided by the individual timeshare resort is included in the cost of our services. We will investigate the timeshare's status with your individual resort and report any and all information gathered directly to you.
Preparation of necessary documents
We will prepare the appropriate documents, whether a Grant Deed, Quitclaim Deed, Membership Transfer or Warranty Deed. All of these documents are attorney-reviewed and access to a representative is constant should you have any questions.
Recording fees and other aspects of timeshare deed recording
This office files all documents with the clerk of court appropriately at no additional cost.
Providing resorts with notice of change of ownership
Your resort will be notified of the transfer of your ownership or membership.
Do You Accept All Timeshares Anywhere?
We can accept Timeshare gifts in all 50 states, Mexico, Canada and the Caribbean.
We may not be able to accept timeshares with an outstanding mortgage that the donor is unable to pay off, one with overdue annual maintenance fees or occasionally where the Timeshare has been allowed to deteriorate badly.
What if you don't live in the U.S.?
Non-US residents are welcome to donate timeshares. However, if you are interested in receiving a tax write-off for this donation in your home country you must first consult a tax advisor and find out if this donation would qualify for a write-off.
How long will the donation closing process take?
The closing process takes approximately 120 days not including the time the county takes to record the new deed.
What about Annual Fees and Mortgages?
All maintenance fees and charges must be current and fully paid at the time the gift is made. The Timeshare needs to be free and clear of any outstanding mortgage. If the value of the Timeshare is high and the mortgage is low, it is sometimes possible to work something out. However, this is the exception. All donors are responsible for keeping their account current throughout the donation process. If the process is completed and the usage is still available you will be reimbursed all or part of the fees for that use year.
What is the Right Of First Refusal (ROFR)?
The right reserved by some resorts to take the position of a buyer in a contract to purchase one of their timeshares. If the resort elects to purchase the property they must buy it at the same price and conditions as stated in the contract.
What If I Just Walk Away From My Timeshare?
Some unknowing owners have begun to simply walk away from their properties and maintenance fees which ruins their credit and doesn't eliminate the liability. Late fees, taxes and assessments will continue to compound as a legal debt and the lack of payment can be reflected on credit reports.
The legal obligation of walking away from a timeshare is the same as if you walked away from any financial obligation (car payment, house payment, credit card payment, etc.). The resort will turn your name over to a collection agency that will then hound you for your maintenance fees and if you don't oblige then the resort will ruin your credit.
Combine this with the difficulty of securing reservations and the low cost of booking travel online, timeshare ownership begins to look like more of a burden than an asset.
I was told my timeshare is worth over $10,000 on the resale market and it should sell within a few months, how do I find out the real value of my timeshare?
Property Donation Group will never exaggerate or diminish the value of your timeshare. The truth is that there is no legal Appraisal that can be performed on a timeshare. A true "Comparative Market Analysis" would show that there are over 5 million timeshares available for sale mostly "By Owner" and perhaps 1% sell at all. Unfortunately the company who told you that your timeshare was sellable at that price was giving you false information for the purpose of collecting an upfront listing or advertising fee.
Why do People Gift Their Timeshares to Charity?
Our clients want to help others that are less fortunate and are pleasantly surprised to find that they can dispose of an unwanted Timeshare at the same time. The original intended use of the Timeshare may no longer exist. The owner may have moved, the time slot may be inconvenient, health concerns may no longer permit easy use, or as the family has grown up, it may simply be the wrong size or location. Sometimes a couple has purchased the Timeshare, but one partner becomes ill or passes away and the Timeshare becomes impractical.
Other Timeshare owners find that the annual maintenance fees outweigh the value of the property in their situation. It can also be much easier to give a property to charity than to deal with the difficulties of trying to sell property in a distant location and competing with Timeshare developers offering attractive incentives.
In the end, donors receive a valuable service, a tax deduction and they feel good knowing that they've helped pay for programs that may one day help save the life of a loved one, or even themselves.
Once I donate a Timeshare, who then owns it?
Upon receipt of your donated Timeshare, the charitable organization becomes the owner of the item. We handle the turn-key liquidation service for the non-profit (e.g. inventory, auction, shipping, conversion into cash), but ownership remains with the charity.
